Content

All services provided by VPS Village may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. this includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secrete and other statue. The subscriber agrees to indemnify and hold harmless VPS Village from any claims resulting from the use of the service which damages the subscriber or any other party.

Pornography and sex-related merchandising are prohibited on VPS Village servers. This includes sites that may Link to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to VPS Village servers or any other server on the internet. Links to such materials are also prohibited.

Examples of non-acceptable content

Pirated software, music, and movies
Bulk Email related products
Hacking/cracking related websites
Adult Pornography/Nudity
Child nudity or pornography, without exception
Websites operated by, or paid for by any organization or government supporting or defined as a Terrorist Organization by the US Department of Defense
Sites containing or linking to material that may be considered detrimental to the public health, safety, or welfare as prohibited by law.

VPS Village will be the sole arbiter as to what constitutes a violation of this provision, and reserves the right to deactivate and remove any site at any time for any reason without refund!

System Resource Usage

If VPS Village's system administration team determines that a customer's account is utilizing an unacceptable amount of system resources, including but not limited to Bandwidth, VPS Village may temporarily deactivate the account in question. If VPS Village's staff deems necessary, an eviction notice may be sent to the customer of an offending account providing them with ten (10) days in which to either upgrade to a larger account (if presented as an option), purchase a dedicated server, or locate a new provider. This only occurs in extreme cases.

VPS Village will be the sole arbiter as to what constitutes a violation of this provision. Because of the nature of this provision, each account will be considered and analyzed individually.

VPN Connectivity

Client is allowed to run a VPN through the VPS Village network. Client is warned that by doing so, they invite a risk of intrusion into their private computer networks. VPS Village assumes no responsibility for losses, real or imaginary, as the result of an intrusion into systems owned, operated, or within the vicinity of Client as the result of Client's VPN configuration.

Public Proxies

Client is forbidden from using the VPS Village network to host a public proxy server or Tor exit node which would allow unauthorized, public access. Client is permitted to use the VPS Village network to host a reverse proxy or private proxy service.

Chat Rooms & IRC

Client is allowed to operate an IRC server, but may not "link" to other IRC Servers, or join IRC Server networks. Examples of such prohibited server networks include, but are not limited to: EFnet, Dalnet, Undernet, and Freenode.

Operation of non-IRC chat services is allowed, but may be subject to scrutinization on a case-by-case basis.

Client may operate IRC bots, but may be subject to scrutinization on a case-by-case basis. IRC bots must comply with all other rules related to the distribution and storage of illegal materials; thus, XDCC bots serving pirated materials or facilitating gambling are not allowed.

Email Abuse

Spamming and "Phishing", or the sending of unsolicited email, from a VPS Village server is STRICTLY prohibited and enforced. Using SPAM to advertise a site hosted on the VPS Village network also constitutes as a violation of this provision. VPS Village will be the sole arbiter as to what constitutes a violation of this provision.

We supply the following email guidelines:

The emails are solicited and of a non-advertising nature.
Addresses are collected first-hand and not through a third party.
Addresses are added via double opt-in address verification process.
Clients provide an easy, unencumbered unsubscription procedure.
Email headers and content must not be crafted in a way that could be confusing or misleading to the receipient.
The account must abide by the laws of all applicable jurisdictions. This includes at a minimum, the federal laws of the United States, and the laws of the Commonwealth of Pennslyvania.

Server Abuse

Attempts to undermine or cause harm to a VPS Village, VPS Village servers, or customers of VPS Village is strictly prohibited and will result in account termination.

VPS Village will be the sole arbiter as to what constitutes a violation of this provision.

Failure to Follow Policies

If any terms or conditions are failed to be followed it will result in grounds for account deactivation. Any accounts and/or servers contained within the VPS Village network must adhere to the above policies.

We reserve the right to remove any account without prior notice. If we deactivate your account for violating policy, your will forfeit your rights to a refund--and none will be given. Our normal policy is a warning first, and account deactivation the second offense, but no warning is required.

VPS Village reserves the right to deactivate and remove any site hosted on our servers that contains any content that it deems in its sole discretion to be unacceptable or undesirable.

RIGHT TO REVISION

VPS Village reserves the right to revise these policies at any time, without notification, in order to ensure a secure and stable environment on behalf of Client. If Client chooses not to accept revisions of this document, VPS Village reserves the right to terminate Client's account without obligation or penalty.

LIMITATION OF LIABILITY

VPS Village, including but not limited to its officers, directors, owners, employees, and contractors, shall not under any circumstances be liable for any direct, indirect, incidental, special, consequential, exemplary, or any other type of damages, including but not limited to damages for loss of profits, goodwill, use, data or other intangible losses even if VPS Village has been specifically advised of the possibility of such damages.

DISCLAIMER OF WARRANTIES

Your use of the Services is at your sole risk. The Services are provided on an "as is, as available" basis.
VPS Village expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
VPS Village makes no warranty that the Services will meet your requirements; that the Services will be uninterrupted, timely, secure, or error-free; that the results that are obtained from your use of the Services will be accurate or reliable; and that any errors in the Services will be corrected.
No information or statement, whether oral or written, obtained by you from VPS Village or its officers, owners, directors, employees, or contractors shall create any warranty not expressly stated in the Terms and Conditions.

SECURITY OF TERMS

In the event that any provision of these terms shall be held invalid or unenforceable by any court of competent jurisdiction, such holding shall not invalidate or render unenforceable any other provision hereof.
